Inside a DMV Administrative Hearing

When the DMV proposes to suspend or restrict a driving privilege, you are generally entitled to ask for a hearing. It is an administrative proceeding run by the department, and it is unlike the court experience most people are picturing.

Who runs it

A DMV hearing officer, not a judge. The setting is an office rather than a courtroom, and the hearing is often conducted by telephone. The proceeding is recorded.

What is being decided

Only the department's own action — whether the driving privilege is suspended, restricted, or left alone. The hearing officer is not deciding a criminal case, not deciding fault for an insurance claim, and not reviewing what a court did. That narrowness is the point: it is a hearing about your license.

The deadline is the whole thing

The notice that arrives states a period within which you must request the hearing. Miss it and, in most circumstances, the action proceeds without one. This is the single most common way people lose an argument they might have won — not by losing, by not asking in time. Read the notice the day it arrives and diary the deadline.

What you can do at one

• Be represented, at your own expense, if you choose to be.
• Present documents and evidence relevant to the department's issue.
• Examine the evidence the department is relying on.
• Testify, or decline to.

Financial responsibility hearings

Where the issue is proof of insurance after a reportable collision, the question is documentary: was there coverage in force on the vehicle on the date in question? That is answered with a declarations page or a carrier letter naming the date, not with a current insurance card. Bring the document that covers the day the department is asking about.

Afterwards

The decision comes in writing. If the outcome includes a suspension, the notice will state what is required to restore the privilege, which often includes filing proof of financial responsibility for a period. Keep every piece of paper — you will need it to prove the sequence later.
