The Offense Is the Leaving, Not the Crash

This is the point that gets lost. A collision, on its own, is generally not a criminal matter. Leaving one is. California charges hit and run based on the departure — which means a driver who was not at fault for the crash can still be the only person facing a criminal charge afterwards.

The two statutes

Vehicle Code section 20002 covers leaving after a collision resulting in damage to property. Section 20003 sets out what a driver must do where there is injury or death. Both describe duties that attach at the moment of the collision, and both are violated by driving away from them.

Fault genuinely does not matter

Read that again if it is new to you. If another driver runs a light and hits you, and you leave the scene without stopping and exchanging what the law requires, you have a problem they do not have. The duties are triggered by involvement, not by blame.

Why people leave

In the calls we take, the reasons are almost never sinister. No insurance and panic. An expired license. A suspended registration. Fear of an immigration consequence. Simply not realizing a contact occurred. Every one of those situations is smaller than the charge that comes from driving away from it.

What it costs beyond the court case

• A conviction the DMV treats as one of the serious ones, with a heavier point value and a long retention period.
• A driving record entry that follows you through every insurance application for years.
• A markedly narrower set of carriers willing to write you afterwards.

The preventable version

Most of the panic that produces this offense traces back to being uninsured. That is a fixable condition, and it costs very little to fix relative to what it prevents. If that is the reason someone in your household would be tempted to drive away, fix it now rather than after.
